Introduction

Pret-a-Portrait aims to provide excellent customer service in everything it does and to operate in a completely transparent, fair and reasonable way at all times. These terms and conditions are here to help you know where you stand and what to expect.

We always aim to strike the right balance between meeting the needs and demands of our customers with what is practical and reasonable from a commercial perspective.

There are some significant difference between Pret-a-Portrait and other types of online shopping you may be familiar with – mostly because every item we sell is essentially a tailor-made ‘one-off’ rather than something we can just pull off a shelf in a warehouse.

General Information

Pret-a-Portrait Ltd is a limited company registered in England and Wales with registered company number 4855987 and whose registered office is at 30 City Road, London EC1Y 2AB, UNITED KINGDOM. (“Pret-a-Portrait”)

All references throughout these Terms and Conditions to ‘us’ and ‘we’ refers to Pret-a-Portrait.

When you buy an item or service from www.pret-a-portrait.net the following Terms & Conditions apply.

These terms do not affect your statutory rights under English Law.

Your contract for purchases made through www.pret-a-portrait.net is with Pret-a-Portrait Ltd and you undertake that all goods ordered by you are for your own private and domestic use only and are not for publication or re-sale.

You warrant that all details you provide for the purpose of ordering or purchasing goods are true, accurate, current and complete in all respects; and that the credit or debit card or cheque book you are using is your own and that there are sufficient funds in your account to cover payment of the product(s) ordered.

You warrant that you are buying pictures of yourself or of your own friends and family, and that where you are not the subject, or parent or guardian of the subject, that you have the subject or the subject’s legal parent or guardian’s consent to do so. In addition, you warrant that there is no moral or legal reason why you should not be viewing or purchasing the pictures.

You agree that you are happy for us to use email as the primary means of communicating with you.

Approval items

For some products (e.g. multi-image prints, specific re-touching requests etc) we request that customers approve the finished editing before we go ahead with production. This helps avoid problems at a point in the process where revisions are difficult and/or expensive.

Delays in customers giving us their approval (or requesting further work) can add significantly to order turnaround times.

To avoid unnecessary delays we will advise you by email as soon as an approval item is ready for you to view and send regular reminders for up to 3 weeks. If we have not heard back after this time we will consider the item to be ‘auto-approved’ and proceed with the order.

If any changes are requested after this time we reserve the right to make an appropriate charge.

Cancellations & amendments

We will do our best to accommodate any requests for order amendments or cancellations, provided that they reach us before we have started processing the order. Once we have started work on an order we cannot promise to accommodate any such requests and where any such requests are accommodated we reserve the right to make an appropriate charge.

Please note that the time between an order being placed and work commencing will vary according to our workload, but will often be less than 24 hours. If you want to cancel or amend an order, please contact us as a matter of urgency.

Copyright

Pret-a-Portrait Ltd owns the copyright in all the pictures it takes, except where copyright in a picture, or set of pictures, is specifically re-assigned in a written agreement. Unauthorised reproduction of any images without permission is strictly prohibited.

Customers who buy JPEGS will be granted permission to use these in any way they choose, provided it is solely for their own personal and private use. This permission specifically excludes the use of these images for any business or commercial purposes or for publication or broadcast without separate and specific consent.

These terms are covered in and supported by the Copyright Designs and Patents Act 1988

We try to strike the right balance between meeting the needs and demands of our customers with what is practical and reasonable from a commercial perspective. If there is ever anything that you would like to discuss please let us know.

Delivery Times

Every item we supply is made individually to order by experts; each print, each frame, each canvas, acrylic, book or alloy box. Each picture is checked and edited before it is sent to print. Every frame is hand-made, and each inner mount hand cut. In short, Pret-a-Portrait is not the kind of business where items can simply be taken off a shelf and despatched, or where a damaged item can instantly be replaced.

We publish target delivery times for each product on our website and do our very best to turn each order round within this time. In the vast majority of cases we succeed in this aim. Delivery times cannot however be guaranteed.

Most customers will receive and email when their order (or part order) is despatched, describing how it is being sent and when it is likely to arrive. (This is not always available outside the UK, and does assume we are provided with an accurate and regularly monitored email address).

Whilst we will always do our best to help, Pret-a-Portrait cannot take responsibility for any problems that may arise with deliveries that occur once an order is in the hands of the Royal Mail or any other external courier service.

Earlybird deadlines

Many, but not all, customers will be offered a discount for order placed before a specified date – the EARLYBIRD DEADLINE or EARLYBIRD DATE. This date will be published on the welcome page when you first view your pictures, and on your viewing card or paperwork (school photography only).

Our website will be programmed to accept orders at the discounted rate up until midnight on the specified date. Telephone orders will have to be placed by the end of the working day (generally 6.00pm) on the specified date.

We reserve the right to extend the discount in exceptional circumstances, but this is not guaranteed and it solely at our discretion.

Faulty or damaged goods

In the unlikely event that you receive goods which are not what you ordered or which are damaged or defective, or are of a different quantity to that stated on your order, please advise us within 10 days of the despatch date. We will normally be happy to make good any shortage or replace or repair any damaged or defective goods, but reserve the right to satisfy ourselves that any such claim is legitimate and may require any damaged or faulty goods to be returned. This provision does not affect your statutory rights.

Payment & Prices

We accept most major credit and debit cards. We can accept card payments online, or by telephone.

We can accept online banking payments; our bank account details will be offered online when selecting this option.

We can only accept cash payments by special arrangement. Please do not mail cash.

All orders must be paid in full before we can begin to process them. Orders from customers who opt to send a cheque will not be processed until the cheque has arrived and the cheque had cleared into the Company’s bank account. In the event that cheques are returned unpaid by the bank we reserve the right to suspend the order until payment has been made successfully.

All prices featured online in price lists or in the online shop include VAT (or other local sales taxes where relevant) at the prevailing rate.

The Company reserves the right to change information, prices, specifications and descriptions of listed goods, products and services at any time and without notice and does not accept liability (except as set out below) for any errors and/or omissions contained in our website.

If an error is discovered in the price of the goods that you have ordered, we will inform you as soon as possible. We shall be under no obligation to fulfil an order for a product that was advertised at an incorrect price. In the event that you order and the price published on www.pret-a-portrait.net is incorrect we will contact you to inform you that we have not accepted your order. You will be advised of the correct price of the product. You will be given the option to cancel your order or to choose to continue at the correct price. If you wish to cancel your order and you have already paid for the item, we shall refund the full amount within 30 days of the date of order. Should you choose to re-order at the correct price, an adjustment transaction will be made.

Privacy & Security

Pret-a-Portrait Ltd will not pass on your personal information or your credit or debit card details to any third party, other than is directly required to fulfil your order (i.e. address to couriers)

Our website is configured so that it is not possible to view any given set of pictures without either the correct Sitting ID or a legitimately registered customer’s account login details. All customer account passwords are encrypted. Customers should take appropriate care to ensure that their own login details are kept safe and secure. Pret-a-Portrait cannot be held responsible if your account details are used by someone else to view pictures or place orders.

We will not normally ask for personal details via email. If you receive an unsolicited email asking you for your www.pret-a-portrait.net log in details, please contact our Customer Service team immediately.

We will take all reasonable steps to ensure that Sitting ID’s are only issued to those legitimately entitled to view pictures. We may ask questions to verify your identity if you lose a Sitting ID or forget your login details.

Retouching

For most items* our standard practice is to automatically re-touch all ordered images before printing.

This will automatically include:

  • modest adjustments to the crop where necessary to achieve the correct size and/or to help remove extraneous background (see below)
  • cleaning up the floor and background of white studio pictures to make the background clean and white, and removing extraneous background (e.g. edges of backdrops, lights etc) when necessary

If you would like further re-touching (e.g. cleaning up dirty marks on clothing or skin, removing stray hairs etc) please make a specific request at the time of ordering. Most requests can be accommodated at no additional charge, but we reserve the right to make a charge if extensive retouching is requested. As and when this is deemed necessary a cost will be quoted for your approval before the work is carried out.

*Does not apply to whole sitting CD where pictures are whole files, un-retouched, ‘straight from the camera’

Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and you irrevocably submit to the exclusive jurisdiction of the courts of England.

Use of pictures for publicity

Pret-a-Portrait Ltd. undertakes not to use, sell or make available any images from your sitting to any third party for any reason except, where you have given your specific consent, for the promotion of its own business.
